Chairman Alexander Statement on Trump Administration Decision to Rescind the "Persuader Rule"

Senate labor committee Chairman Lamar Alexander (R-Tenn.) today released the following statement after the Department of Labor rescinded the Obama Administration's "persuader rule"

"The Trump Administration's decision to rescind the so-called "persuader rule' is welcome news for American workplaces. The rule undermined attorney-client privilege by requiring employers to tell the federal government that they have, for example, been advised by a lawyer about what they can say to their employees in a speech about a union organizing campaign. According to the Tennessee Bar Association, the rule would have discouraged lawyers from giving legal advice to employers due to confidentiality concerns."

Background:

In 2016, the United States District Court for the Northern District of Texas ruled that the rule exceeded the Obama Administration's authority under the Labor-Management Reporting and Disclosure Act and issued a nationwide permanent injunction of the rule.
